Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of Apnakul websites, mobile applications, and related community services (the “Services”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.
1. About Apnakul
Apnakul is a community platform for Kirar, Dhakad & Malav Samaj and related membership features, including (where enabled) directories, help requests, news, shops, and matrimony-adjacent profile listings. Features may change as the platform evolves.
2. Eligibility & accounts
- You must be legally able to enter into these Terms under applicable Indian law.
- You must provide accurate information and keep your profile reasonably up to date.
- You are responsible for safeguarding your device and OTP / login credentials.
- One person should not create multiple accounts to evade moderation or bans.
- We may refuse, suspend, or terminate accounts that violate these Terms or applicable law.
3. Acceptable use & community guidelines
You agree to use Apnakul respectfully and lawfully. You must not:
- Post false, misleading, defamatory, obscene, or illegal content;
- Harass, threaten, stalk, or exploit other members;
- Misuse contact details obtained through the Services;
- Upload content that infringes others’ rights (privacy, publicity, intellectual property);
- Attempt to hack, scrape without permission, disrupt, or reverse-engineer the Services;
- Use the platform for spam, fraud, scams, or commercial abuse outside allowed listings;
- Impersonate another person or misrepresent your identity or affiliation.
Community content is moderated. Approval of a listing or profile does not mean Apnakul endorses its accuracy. Report concerns via in-app Team info or admin@apnakul.com.
4. Profiles, listings & user content
You retain rights in content you submit, but you grant Apnakul a non-exclusive, worldwide, royalty-free licence to host, display, moderate, and distribute that content as needed to operate the Services. You represent that you have the rights to submit the content and that it is accurate to the best of your knowledge.
We may edit, refuse, or remove content that violates these Terms, community standards, or law. Public listings may be deactivated when an account is deleted or banned.
5. Matrimony / matchmaking features
Where matrimony or matchmaking-related features are offered, they are tools for community introduction and information sharing. Apnakul is not a party to any marriage, engagement, or personal arrangement between users. Verify information independently and exercise caution when meeting or sharing sensitive details.
6. Third-party services
The Services may rely on third parties (SMS/OTP, hosting, maps, push notifications, app stores). Their terms and privacy practices apply to their services. We are not responsible for third-party outages outside our reasonable control.
7. Intellectual property
Apnakul name, logo, design, and software are protected by applicable intellectual property laws. You may not copy, modify, or redistribute our branding or proprietary materials without prior written permission, except as allowed by law.
8. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Apnakul disclaims warranties of uninterrupted availability, perfect accuracy of user-generated content, or fitness for a particular purpose. Community moderation reduces risk but cannot eliminate all misuse.
9. Limitation of liability
To the maximum extent permitted under Indian law, Apnakul and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Services or interactions with other members. Our aggregate liability for claims relating to the Services shall not exceed the greater of (a) amounts you paid us for the Services in the three months before the claim (if any), or (b) INR 1,000. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnity
You agree to indemnify and hold harmless Apnakul and its operators from claims arising out of your content, your misuse of the Services, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.
11. Suspension & termination
We may suspend or terminate access for violations, legal risk, or operational reasons. You may stop using the Services and request account deletion via the app or apnakul.com/delete-account. Provisions that by nature should survive (including liability limits, indemnity, and governing law) survive termination.
12. Changes to the Terms
We may update these Terms periodically. The “Last updated” date will change when revisions are published. Continued use after changes constitutes acceptance where permitted by law.
13. Governing law & disputes
These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you. Prefer resolving concerns first by contacting admin@apnakul.com.
